Important: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage or cancel your subscription at any time through your device:
All subscription purchases are processed through the Apple App Store. Refund requests must be submitted to Apple directly through their Report a Problem page. We cannot process refunds directly.
Kaeru is not a medical device and does not provide medical advice.
The calorie estimates, nutritional information, and health-related data provided by Kaeru are for informational purposes only and should not be used as a substitute for professional medical advice, diagnosis, or treatment.
Always consult with a qualified healthcare provider before making any changes to your diet or health regimen.

All content, features, and functionality of Kaeru are owned by Benjamin Lobmueller and are protected by international copyright, trademark, and other intellectual property laws.
To the maximum extent permitted by law, Benjamin Lobmueller shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
We reserve the right to modify, suspend, or discontinue the App or any part thereof at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.
We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page. Your continued use of the App after such changes constitutes acceptance of the new Terms.
The following terms apply to the use of Kaeru when downloaded from the Apple App Store:
You acknowledge that this End User License Agreement ("EULA") is concluded between you and Benjamin Lobmueller only, and not with Apple Inc. ("Apple"). Benjamin Lobmueller, not Apple, is solely responsible for Kaeru and its content. This EULA may not provide for usage rules that are less restrictive than the Apple Media Services Terms and Conditions as of the date you obtained the license (the "Usage Rules").
The license granted to you for Kaeru is a non-transferable license to use Kaeru on any Apple-branded products that you own or control as permitted by the Usage Rules. Except as provided in the Usage Rules, you may not distribute or make Kaeru available over a network where it could be used by multiple devices at the same time. You may not transfer, redistribute, or sublicense Kaeru. You may not copy (except as permitted by the Usage Rules and this license), reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of Kaeru, any updates, or any part thereof.
Benjamin Lobmueller is solely responsible for providing any maintenance and support services with respect to Kaeru, as specified in this EULA, or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to Kaeru.
Benjamin Lobmueller is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of Kaeru to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for Kaeru to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Kaeru, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Benjamin Lobmueller's sole responsibility.
You acknowledge that Benjamin Lobmueller, not Apple, is responsible for addressing any claims by you or any third party relating to Kaeru or your possession and/or use of Kaeru, including, but not limited to: (i) product liability claims; (ii) any claim that Kaeru fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with Kaeru's use of HealthKit. This EULA does not limit Benjamin Lobmueller's liability to you beyond what is permitted by applicable law.
You acknowledge that, in the event of any third-party claim that Kaeru or your possession and use of Kaeru infringes that third party's intellectual property rights, Benjamin Lobmueller, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with applicable third-party terms of agreement when using Kaeru. For example, if you use a VoIP application, you must not be in violation of your wireless data service agreement when using Kaeru. You are solely responsible for any charges or fees incurred by your use of third-party services in conjunction with Kaeru.
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Benjamin Lobmueller operates, without regard to conflict of law principles.
